eh, just one more little annoying question about copyrights and stuff

well guys excuse me for creating another stupid topic, but I just realy need some help, to figure those things out

 

suppose that I wanna make mod for non-JK game, that would be based on JK, what resourses from JK games can I use?

I mean it's clear that I can't use JK models or maps. but can I use concepts of them, I mean can I recreate those models and maps without using JK resourses but based on JK designe, would it be legal?

the same goes about JK stories, can I base my mod story, on JK games scenario, or it would violate copyright?

and, the last one, can I use sounds from JK, I mean actor's replic? gues that would be illegal, but I seen some great work on youtube that actually uses kyle's replic,

so, does it mean that, theoretically, I could use these voices too?

Generally, no, you can't use the Star Wars IP without permission pretty much ever. Practically, it's up to them to tell you to stop, which they might not. And you can't use any assets, either, until it's explicitly allowed.

 

The one exception is that Raven/LucasArts allowed porting of JK2 Assets to JKA.

well, is it so bad? I mean, he done nice video, he have no profit for himself, and even copyright owners seems to don't care... so maybe it's okay then? or don't?

Developers don't really care to in depth about copywrite till you try making a name for yourself, basically.  It ties into money.  Him doing small scale videos using another game engine/source doesn't really bug them to much, like showing off a small tech demo..  What bugs them is using and recreating something on a newer or different engine, as well as people trying to make money off it(just my opinion).

 

This is why, say garry's mod, has tons of ported content but it was not really released for someone making a name for themselves nore for making money either.  Despite all that if Lucasarts wants to or even Raven, they can still get said content removed and complain to the person who made it.  It's a thin ice sorta deal when dealing with assets.  Can read up on the disclaimers and what not, for a lot of things they're more or less the same anyway, but they can send out a cease and a desist anytime they see this kinda stuff regardless of what stage any piece of work is in.

The moral decision is up to you, but the fact of the matter is, it's illegal and a company could take action. Nobody here is stopping you from trying, but the company will sure as hell stop you if they desired to.

Copyright is copyright. In reality, there's much more that could be going on than strictly financials. It's about protecting a brand. I mean, could you imagine if the internet was flooded with fan-made porn using those models? It would hurt the brand for sure.

well first of all I didn't even intended to use asests or original resourses from the game, since it's clear that it is illegal, all i talk about, is use concepts from the game to recreate those resourses
second i had no idea of making any profit from such things

third, about making a name... it's kinda ridiculous idea, that someone would try to make himself a name, while it's obviously to public that he based his work on someone elses, well known, ideas

 

I guess, it's grown-up conversation, about possible motives, money or fame, while personaly I motivated only with desire to have fun... I mean like in childhood we use to play a jedi with my friends, so did we violate copyright back in those days, since we use those names form the movies without permition

 

so, in the end, I gues nobody of fans would like such JK based mod for another game,
even if it would be noncommercial, wouldn't use any original resources of JK (models/textures/sounds),
even if none of its creator will try to make a "name" for himself, and copyright owners wouldn't stop mod's development
you still gonna decide it's illegal, wouldn't be interested in such mod, and wouldn't play it

c'mon, nobody realy need some fan's 3d models to make porn with something, it could be simply painted... and most probably it's already painted, I mean internet has porno about everything, even damned pokemons, I strongly doubt, that there is no porn with kyle katarn and others somewhere in internet

but, after all, idea, that some sort of this dirty content, hurt brend is kinda questionable too, i mean if it hurts every brand the same, then it hurts none of them

I don't care if it's illegal and to be fair, in this context, it is extremely unlikely that anyone that matters will step in to do anything about your modding adventures. If you think it's a good idea, then just go for it.

Well at this point no one can mod anything.

If raven not want mod, why release the SDK and MP and SP code? i not see problem in mod and use staff of JKA. the problem is if someone use JKA engine, texture etc for make a custom game and try to get cash and money from his creation. In this case, Disney can slash him with a tribladed lightsaber.

I think the point most people are trying to make is: if you're going to violate copyright, don't come whinning to us about how you got sued/cease and desisted if something goes horribly wrong.  Like others have said, LucasArts/Raven/Disney is unlikely to do anything to you even if you are violating copyright illegally - but it is always a possibility.  Instead of worrying about it though, why not just find some assets where permission to use them in other works is granted?

This, mostly.

I mean, I don't have a problem with people making videos, machinimas, whatever. I think drawing the line is when you're either making a profit from it (and I don't mean petty YouTube profits fwiw) or you're passing it off as your own. As long as you're not doing either of those, I can't hardly be upset with someone using the material...

..unless it's not very good, that is. :P

Semi-related: I know that someone once made a KotOR pack for JKA and Lucasarts/Bioware gone quite batsheet crazy about it. It was quite a few years ago. Do you think they still frown upon such a thing? Also, I tought that when JKA became open source it pretty much become an abandonware?

Code itself might be open source, but the assets are not open source (otherwise people could get full source files to all the game models, animations, etc).  People still have to pay for those when they buy the digital copies of the game also.  Those are still under the copywrite itself.

Usually they only go crazy if you port stuff.  If it is made from scratch they don't usually care.  (For examples search the files section on jkhub for "kotor").

 

JKA is not abandonware, just because its source code was released.

Too bad. Porting is exactly what I wanted to do. A Multiplayer-KotOR on JKA engine is something I wanted for long.
